Who Should Attend: HR Directors or those with HR functions, managers and supervisors

ADAAA SESSION: 

The Amendments have greatly expanded the definition of what is a qualifying disability under the ADA and has established other more subtle changes to the law. Now that the regulations have been finalized, it is a good time to review this law and regulations. This session will also delve into GINA, which made it illegal for employers to collect genetic information and their family medical information.

Learning Objectives:

  • Identify what qualifies as a disability under the ADAAA.
  • Engage in the interactive process with employees who request a reasonable accommodation related to their disability.
  • Comply with medical confidentiality requirements related to disability requests and GINA.
  • Identify and acknowledge disability harassment, retaliation, and employer's obligation to take corrective action should disability harassment and/or retaliation be reported.

 

FMLA SESSION:

The Family and Medical Leave Act is a legal minefield where one mistake from an untrained supervisor can create serious liability for the organization.  It is a complex law with far-reaching implications if it isn’t applied correctly.

This course updates supervisors on the current regulations of the Family and Medical Leave Act and explains their responsibilities throughout the process. Throughout the session, participants will compile an extensive FMLA toolkit, which they will bring back to their organizations.

In this interactive session, participants will explore and assess their current FMLA practices in conjunction with other leaves of absence to ensure compliance with state and federal laws.

Learning Objectives:

  • Assess and modify FMLA practices to ensure compliance  
  • Articulate the importance of the consistent application of FMLA within an organization
  • Recognize and identify resources to support the FMLA process

Topics to be covered:

FMLA Basics, recent legislative changes, the importance of consistent application of FMLA, FMLA resource toolkit

    Carol Kilmister

    Carol Kilmister is a Senior Human Resource Consultant in the Legal and HR Services Department at Primex3 where she provides training, guidance, and support to Property & Liability members.  Prior to coming to Primex3, she worked for many years as the Director of HR for a multi-district SAU in NH.  She is a graduate of Rivier University with a Master of Science degree in Human Resource Administration and holds a Bachelor of Science degree in Business Administration from Plymouth State University.  In addition, she holds national certification as a senior HR professional from both HRCI and SHRM. She serves on the board of directors of the Greater Concord HR Association of SHRM (HRAGC) as well as the Association of NH Public Employer HR Administrators (ANHPEHRA).

    David Bullock

    David Bullock currently serves as the Claims and Coverage Consultant at Primex3. David is responsible for handling property and liability claims, providing human resource guidance for members and responding to coverage inquires. David has developed a specialized expertise in employment related claims. David recently received his Chartered Property Casualty Underwriter designation and his SHRM Certified Professional designation. David previously worked as an Anti-Discrimination Investigator for the New Hampshire Commission for Human Rights, the state agency charged with enforcing the state civil rights law in employment, housing, and public accommodations. David graduated from Ohio University receiving a Bachelor of Arts in English and History and from the University of New Hampshire receiving a Master’s Degree in Public Administration.
